(1) For the purpose of adjustment of employees in accordance with this Act, the position of the Chief Secretary of the Provincial Government and the Secretary of the Ministry of the Provincial Government shall be considered to be the position of the Federal Civil Service.

( 2) The Government of Nepal shall assign employees from the civil service to the posts of Chief Secretary of the Province and Secretary of the Ministry of the Province in accordance with the prevailing law. After that, such position will automatically be considered as a state civil service position.

(4) According to sub-section (2) when appointed to the post of chief secretary of the province, from among the gazetted special category employees and when appointed to the secretary position of the provincial ministry, from among the gazetted first class employees of the related service, group or sub-group. As far as possible, they will be appointed on the basis of seniority and performance.

(5) Employees appointed in accordance with sub-section (2) shall be fully accountable to the provincial government.
